Personal Data Protection Notice

Important note

Who is the data controller?

Under Turkish Personal Data Protection Law No. 6698 ("KVKK"), the data controller for processing related to this website is: [VERİ SORUMLUSU — TEYİT GEREKLİ: Ad/Unvan, adres, e-posta, KEP].

Once you send an appointment request from your own WhatsApp account or e-mail address, the clinic you chose processes it as an independent data controller. Dr. Maryam Fazeli practises at the following clinics:

  • Nifa Dent International Ağız ve Diş Sağlığı Polikliniği — Kazımdirik Mah. 372/32 Sk. No:3, Bornova / İzmir [İŞLETMECİ TİCARİ UNVANI VE KEP — TEYİT GEREKLİ]
  • Özel İzmir Dent Ağız ve Diş Sağlığı Polikliniği — Yunus Emre Mah., Şht. Pilot Volkan Koçyiğit Blv. No:38, 35190 Karabağlar / İzmir · info@izmirdent.com.tr [İŞLETMECİ TİCARİ UNVANI VE KEP — TEYİT GEREKLİ]

Processing during examination and treatment is governed by each clinic's own privacy notice. Clinic contact details are on the Contact page.

Who does this notice cover?

This notice is provided under Article 10 of the KVKK and the Communiqué on the Procedures and Principles for Fulfilling the Obligation to Inform. It covers visitors to this website and anyone who uses the appointment form.

How does the website handle your data?

This is a static information website: there are no user accounts and no server-side database. What you type into the appointment form is not stored on the website. Here is how it works:

  1. You fill in the form: name, phone number, preferred language, preferred clinic, topic and message. Ticking the explicit-consent box is mandatory.
  2. When you press Send, your browser opens WhatsApp (wa.me) or your device's e-mail app with a prefilled message addressed to the clinic you chose.
  3. The message only reaches the clinic when you send it yourself from your own WhatsApp account or e-mail address. You can edit it or decide not to send it.
  4. From that point on, your data is processed by the clinic as data controller.

How is the data collected?

Your data is collected electronically and partly by automated means: through the appointment form you fill in and the WhatsApp or e-mail message you choose to send. Server access logs and your preference setting are created automatically while the site runs. For cookies and similar technologies, see the Cookie Policy.

Who may receive the data?

  • The clinic you chose: to assess your appointment request and get back to you. You send the message to the clinic yourself.
  • The messaging service you use: WhatsApp (WhatsApp/Meta) or your e-mail provider. You use these through your own account and their own privacy terms apply. If you prefer not to use WhatsApp or e-mail, you can phone the clinic instead.
  • Hosting provider: [BARINDIRMA SAĞLAYICISI — TEYİT GEREKLİ] — to publish the website and keep it technically secure.
  • Google: only if you choose to load the map.
  • Plausible Insights OÜ: only if analytics is enabled and you consent; cookieless, for aggregated statistics.
  • Competent public authorities and courts: where required by law and on request.

Transfers abroad

Under Article 9 of the KVKK as amended by Law No. 7499 (in force since 1 June 2024), personal data may be transferred abroad where there is an adequacy decision for the country; failing that, where one of the appropriate safeguards is in place (e.g. standard contractual clauses notified to the Board, binding corporate rules, a written undertaking); and, where neither applies, only in one of the incidental, exceptional cases listed in the law (e.g. explicit consent).

Servers of Google Maps (Google), WhatsApp (Meta), the analytics service (Plausible, EU) and the hosting provider ([BARINDIRMA SAĞLAYICISI — TEYİT GEREKLİ]) may be located outside Türkiye. The mechanism applicable to each transfer must be determined by a lawyer [TEYİT GEREKLİ].

How long is the data kept?

  • Appointment form data: not stored on the website. Messages received by a clinic are kept under that clinic's retention and destruction policy and the periods set by health legislation.
  • Cookie/consent choice: stays on your device until you clear your browser data [RE-PROMPT PERIOD — TEYİT GEREKLİ].
  • Server access logs: kept by the hosting provider for the period required by law [PERIOD — TEYİT GEREKLİ].
  • Google and Plausible: the periods in their own policies apply; see the Cookie Policy.

When the retention period ends, data is erased, destroyed or anonymised in line with the Regulation on the Erasure, Destruction or Anonymisation of Personal Data.

Your rights under Article 11 of the KVKK

By applying to the data controller, you have the right to:

  • learn whether your personal data is processed;
  • request information if it has been processed;
  • learn the purpose of processing and whether data is used for that purpose;
  • know the third parties, in Türkiye or abroad, to whom it has been transferred;
  • request correction of incomplete or inaccurate data;
  • request erasure or destruction under the conditions in Article 7 of the KVKK;
  • request that third parties who received the data be notified of any correction, erasure or destruction;
  • object to an outcome against you arising solely from automated analysis;
  • claim compensation for damage caused by unlawful processing.

How to exercise your rights

Under Article 13 of the KVKK and the Communiqué on the Procedures and Principles of Application to the Data Controller, you may apply in Turkish: in writing to [VERİ SORUMLUSU — TEYİT GEREKLİ: Ad/Unvan, adres, e-posta, KEP]; via registered e-mail (KEP), secure electronic signature or mobile signature; or from an e-mail address you have previously provided to the data controller and that is registered in its system.

Your application must include your full name, signature (for written applications), Turkish ID number (for foreign nationals: nationality and passport or ID number), your residential or business address for notifications, your e-mail, phone or fax number if any, and the subject of your request.

Applications are answered free of charge within 30 days at the latest; if the request involves an additional cost, a fee set by the Board's tariff may be charged. If your application is rejected, the answer is insufficient or no answer is given in time, you may lodge a complaint with the Turkish Personal Data Protection Board under Article 14 of the KVKK.

For requests about an appointment message you sent to a clinic, we recommend applying directly to that clinic, as the data is held by the clinic, not the website.

By ticking the consent box, you give explicit consent to the information you type (including general information that may count as health data) being passed to and processed by the clinic you chose, in order to assess your appointment request. You can withdraw consent at any time by telling that clinic; withdrawal does not affect the lawfulness of processing carried out before it.
